Terms & Conditions

These terms explain who we are, how our products and services will work, your rights, and what happens if something goes wrong. They'll apply to orders once we open; we'll publish any updates here before then.
About us
Tyneside Digital Studio is a sole trader business. The owner's name and our other business details are under Business information at the end of these terms.

These terms
If you buy as a consumer (for purposes mainly outside your trade or business), you have extra legal rights, which are explained below and are not affected by these terms. If you buy for your business, sections that only apply to consumers do not apply to you. By placing an order, joining the Builder's Club or applying for a VIP Build Session, you agree to these terms.
What we'll sell
- Digital products: Prompt Packs, Bundles, the Prompt Vault and the Agency Starter Kit, delivered online.
- Builder's Club: a monthly membership giving access to the AI Website Builder, prompts, updates, community and support, depending on your plan.
- VIP Build Sessions: a service where we plan and build one website for you and guide you through it.
Example builds and mock-ups are illustrations of what can be built. They are not reviews from real customers unless clearly stated.
Prices and payment
All prices are in pounds sterling (GBP) and include VAT where it applies. Prices are shown before you pay and are taken at checkout through our payment provider. We never see or store your full card details. If we make an obvious pricing mistake, we will contact you before your order is accepted and you can choose whether to continue.
Digital products and your right to cancel
Our digital products are made available as soon as your payment is confirmed. If you are a consumer, you would normally have 14 days to change your mind. At checkout, we will ask you to agree that your digital content can be supplied straight away and to acknowledge that you lose your right to cancel once you start downloading or accessing it.
No refunds for change of mind: because prompts, templates and documents can be used as soon as you have them, we do not give refunds if you change your mind once you have started downloading or accessing a product. This does not affect your legal rights: if a digital product is faulty or not as described, you are entitled to a repair or replacement, or in some cases a refund, under the Consumer Rights Act 2015. Your licence to use our products
When you buy a digital product, we give you a non-exclusive, non-transferable licence to use it in your own business. This includes using our prompts and templates to create websites for your own clients. You may not resell, share, publish or give away our prompts, templates or documents themselves (in their original or lightly edited form), or present them as your own product. All rights not expressly given to you remain with us.
Websites you make with the AI Website Builder
Websites you create belong to you, or to your client once you hand them over. Our prompts, templates and the builder itself stay ours. AI can make mistakes: before a website goes live, check that prices, opening times, claims, legal pages and contact details are accurate, and that you have the right to use every name, logo, photo and piece of text on it. You are responsible for the websites you publish and for your own agreements with your clients. Don't use the builder to make anything unlawful, misleading or harmful, or to copy another business's brand or website.
Builder's Club subscriptions
- Billing: memberships are paid monthly in advance and renew automatically until you cancel.
- Cancelling: you can cancel at any time from your account or by emailing tyneside.digitalstudio@gmail.com. Your access continues until the end of the period you have paid for. We do not refund part-months, except where the law requires us to.
- Your 14-day cancellation right (consumers): you can cancel within 14 days of first joining. If you have already started using the membership, we may deduct a fair amount for the time you have used.
- Price changes: we will give you at least 30 days' notice of any price change, and you can cancel before it takes effect.
VIP Build Sessions
- Applying: applying does not create a contract. We will confirm whether we can take on your project before you pay.
- Price and payment: the price we confirm with you before you pay, paid in full before your planning call unless we agree otherwise in writing.
- What's included: a planning call, one website built to the plan we agree, one round of revisions, and a guided walkthrough on your screen, with a recording. Anything outside this is quoted separately.
- What we need from you: your content, images, logins and feedback on time. Delays on your side may move the delivery date.
- Rescheduling: please give at least 48 hours' notice to move a call.
- Cancelling: if you cancel before your planning call, we will refund you in full. After the planning call, we will refund the price minus the value of the work already done. If you are a consumer and ask us to start within your 14-day cancellation period, you will pay for any work done before you cancel.
- Ownership: once you have paid in full, the finished website design and content we create for you belong to you. Our own tools, templates and know-how remain ours, and we give you a licence to use them as part of your website.
- Third-party services: hosting, domains, booking and payment platforms are provided by third parties under their own terms and fees.
No guaranteed results
Our products and services are designed to help you build better websites, but we cannot guarantee any particular income, bookings, search ranking or business result.
Our responsibility to you
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.
If you are a consumer: we are responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care and skill. We are not responsible for loss that was not foreseeable.
If you are a business: we are not liable for loss of profit, revenue, business or data, or for any indirect loss. Our total liability to you is limited to the amount you paid us in the 12 months before the claim.
Complaints
If you are unhappy with anything, please email tyneside.digitalstudio@gmail.com. We will acknowledge your complaint within 5 working days and aim to resolve it within 14 days.
Changes to these terms
We may update these terms from time to time. The version on our website when you place an order is the one that applies to that order.
Governing law
These terms are governed by the laws of England and Wales. If you are a consumer, you may bring proceedings in England and Wales, or in Scotland or Northern Ireland if you live there.
